Sample Acceptable Use Policy

The publication of user generated content (UGC) by a website operate may create liabilities for the website operator, even where the website operator does not exercise any editorial function and does not moderate the UGC. The AUP may be used to prohibit the types of content that may give rise to this kind of liability. In addition the AUP may be used to prohibit the publication of content that, whilst not unlawful, may be offensive to users.

As well as rules about what UGC can and cannot be submitted to the website, this policy includes an express grant from the website user to the website owner of a right to use the UGC.

How could this template acceptable use policy help to reduce libel risk?

Several of the provisions in the policy have been drafted with libel in mind. First, the publication of libellous material on the website is expressly prohibited. Second, an optional provision provides that factual statements must be true and statements of opinion must be truly held and where possible based on facts that are true. These provisions were drafted to take account of the libel defences of justification and fair comment. Third, the policy provides that the website owner does not actively monitor user content. Monitoring is often impractical, and this approach to user content may help website owners to take advantage of the defence in Section 1 of the Defamation Act 1996.
