Note that a website privacy policy will not usually be required for a personal, non-commercial website. (Under Section 36 of the Data Protection Act 1998, "Personal data processed by an individual only for the purposes of that individual’s personal, family or household affairs (including recreational purposes) are exempt from the data protection principles and the provisions of Parts II and III".)

Do I really need legal terms on my personal website?

Not in the same sense that you would with a commercial website. Commercial websites are almost always subject to statutory disclosure requirements, and terms of use are the usual place for making such disclosures. A failure to make these disclosures can in principle give rise to civil or criminal liability, although sanctions are in fact rare. In any case, at the time of writing (Augsut 2011) no statutory disclosure obligations arise under English law in relation to most purely personal websites.

However, there are two other major reasons for including terms of use on your website.

First, if you care about the use and reuse of the content that you publish on your website, you should have terms of use that define the permitted and prohibited uses.

Second, if there is any risk of liability arising out of the content on your website (e.g. in the tort of negligence) then you should have terms of use that include a disclaimer of liability.
