This email disclaimer is designed for partnerships established in England and Wales.

Email disclaimers have a number of possible functions: attempting to exclude liability in certain respects; attempting to place confidentiality obligations on the recipient of the email; and fulfilling the legal disclosure obligations of the sender. Other possible functions of email disclaimers include attempting to prevent "accidental" contracting, and notifying users about monitoring policies.

The enforceability of email disclaimers is open to question.

This template does not take account of any requirements of any particular regulatory authority, professional body, trade association or code of conduct. These do sometimes have implications for the drafting of email notices. Nor does it take account of the special requirements affecting marketing emails.

Although each of our email disclaimers is more than 1 page long, they are intended to be edited down to a more manageable length.
