Blog T&Cs Q&A

Blog T&Cs Q&A

We have a company blog, and want to limit the republication of material delivered via RSS. Do these terms and conditions include a special RSS clause?

Yes, an optional RSS clause is included. In relation to re-publication, the RSS clause includes an express licence: "we grant to you a non-exclusive non-transferable non-sub-licensable licence to display our RSS feed in unmodified form on any website owned and operated by you". The licence may be limited to allow publication on non-commercial websites only. It may also be made condition upon the retention of an appropriate credit/hyperlink.

I have a directory of industry events linked to my blog. Do the blog terms and use prohibit others from spidering this sort of database?

There is a special clause included relating to automatic means of data collection: "You must not conduct any systematic or automated data collection activities ... on or in relation to this blog without our express written consent".

In addition, the reuse of the data would typically be outside the scope of the licence to use, and may therefore constitute an infringement of copyright or the sui generis database right.
